Terms of use

These are the rules for using Dayling. They are written in plain English on purpose, because an agreement nobody can read is an agreement nobody has really made.
Dayling is operated by Western Cloud ("we", "us"). By creating an account or using the app you agree to these terms. If you do not agree to them, do not use Dayling.
Who may use Dayling
- You must be 18 or older. Dayling is not for children to use.
- You may only add information about a child if you are their parent or guardian, or if you have the permission of their parent or guardian.
- You may only invite somebody into a household if you are a parent in that household, and only if that person has agreed to join it.
- One account is one person. Do not share a login.
Your account
- Give accurate details when you sign up, and keep them up to date.
- Keep your password to yourself. Anything done from your account is treated as done by you, so tell us straight away if you think somebody else has got into it.
- You can close your account at any time in Settings. It removes your account and everything attached to it, and it cannot be undone.
Households and who sees what
Everything logged in a household is visible to every member of that household. A parent decides who joins and can remove anybody at any time. Entries stay with the household when a person leaves, because they are a record of a child's days rather than the property of whoever typed them.
Do not put anything into Dayling that you would not want every member of that household to read.
What Dayling is not
Dayling is not a payroll service and we are not part of your employment arrangement. The app adds up hours and works out figures from the rates and rules you enter. Those figures are a convenience, not a payslip and not advice. You are responsible for what you enter, for checking the result, and for meeting every obligation the law places on you as an employer or an employee, including minimum wage, leave, public holidays, deductions and record keeping. If Dayling and the law disagree, the law is right.
Dayling is not a medical device and does not give medical advice. It lets somebody write down a temperature, a medicine and a dose. It does not check them, does not warn you about them, and must never be relied on to decide anything about a child's health. Speak to a doctor or a pharmacist.
Dayling is also not a substitute for supervising a child, and not a security or monitoring system. In an emergency, call emergency services. Do not use the app to raise an alarm.
What you put in, and who owns it
What you write stays yours. You give us permission to store it, back it up and show it to the other members of your household, which is only what is needed to run the service. We do not use it for anything else, we do not sell it, and we do not use it to advertise to you.
You are responsible for having the right to enter what you enter, particularly where it is about a child or about another person.
The app itself, its name, its design and its marks remain ours.
Using it properly
Do not:
- use Dayling to break the law, or to harass, monitor or intimidate anybody;
- try to reach a household you are not a member of, or anybody's information but your own household's;
- probe, scrape or interfere with the service, or try to get around its security;
- upload anything harmful, or anything you do not have the right to upload;
- resell Dayling or present it as your own.
Availability and changes
Dayling is free at the moment. We may change what it does, add things, remove things, or stop offering it. If we are going to stop, or start charging, we will tell the people using it beforehand and give you a reasonable chance to get your information out or close your account.
We do not promise the service will always be available or free of faults. It depends on things outside our control, including your phone, your connection and the companies listed in the privacy policy.
Suspending or closing an account
You can leave whenever you like. We may suspend or close an account that breaks these terms, that is being used to harm somebody, or that we are required to act on by law. Where it is reasonable to do so, we will tell you why and give you a chance to put it right first.
If something goes wrong
We will do our part properly, but Dayling is provided as it is. To the fullest extent the law allows, we are not liable for loss that follows from using it or from not being able to use it, including lost records, a disagreement about hours or pay, or a decision somebody made based on what the app showed.
Nothing in these terms takes away any right you have under South African law that cannot be taken away, including under the Consumer Protection Act. Where the law says a limit like the one above cannot apply, it does not apply.
Changes to these terms
If these terms change in a way that matters, we will update the date at the top and tell you in the app before the change takes effect. Carrying on using Dayling after that means you accept the new version.
Which law applies
These terms are governed by the law of the Republic of South Africa, and the courts of South Africa have jurisdiction.
